What This Involves

The visual form of a product is often its most copied feature and its least protected one. We advise on where design rights, copyright and trade dress overlap, which route gives a client the most defensible position, and how to act when a product's appearance is imitated.

How We Advise

We assess what is distinctive about the design, what is purely functional and therefore weak, and which protective route is realistically enforceable. We then advise on strategy and act on instruction.

Before a product launch. When a competitor's product closely resembles yours. When designing within an existing market where imitation is common.
